1. Acceptance of Terms
By accessing or using FleetDial (“the Service”), operated by Grovix Studio (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
FleetDial provides AI-powered voice agent technology that enables businesses to automate inbound and outbound phone calls. The Service includes call routing, AI-driven conversations, payment processing facilitation, call recording, and analytics.
3. Account Registration
To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws, including TCPA, FDCPA, or state telemarketing regulations
- Make calls to numbers on the National Do Not Call Registry without proper exemption
- Engage in harassment, fraud, or deceptive practices
- Transmit malware or interfere with the Service's infrastructure
- Impersonate any person or entity
- Use the Service for any illegal purpose
5. Billing and Payment
The Service operates on a pay-as-you-go model based on call minutes used. You agree to pay all fees associated with your usage. Fees are billed monthly and are non-refundable except as required by law.
6. Call Recording and Compliance
You are responsible for ensuring compliance with all applicable call recording laws in the jurisdictions where calls are made or received. The Service provides tools to assist with compliance, but ultimate responsibility rests with you.
7. Data Ownership
You retain ownership of all data you provide to the Service, including contact lists, call scripts, and business information. We do not sell your data to third parties.
8. Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance windows will be communicated in advance when possible.
9. Limitation of Liability
To the maximum extent permitted by law, FleetDial shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
10. Termination
Either party may terminate this agreement at any time. Upon termination, your access to the Service will cease and your data will be retained for 30 days before deletion.
11. Changes to Terms
We may update these terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.
12. Governing Law
These terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
